1. General Conditions
The website www.ourivesariafigueira.com is registered and is the property of Figueira & Oliveira, Lda., with registered office at Rua Príncipe D. Luís 2 and 4, 9360-218 Ponta do Sol, Portugal, registered under legal person identification number 511 019 351, with share capital of € 230,000.00, with the activity title number T4373 of Jewelery Retailer.
These General Terms and Conditions, together with the order form, apply to visitors and regulate the conditions that will govern any transaction of a commercial nature and any provision of services carried out through the “Ourivesaria Figueira” online store. We provide the user with access to the Ourivesaria Figueira online store, through the address www.ourivesariafigueira.com or www.ourivesariafigueira.pt, through which information regarding our products and services will be available.
The user can then, electronically, order the advertised products, under the terms and conditions described here. Browsing our website, as well as purchasing any product, implies acceptance of these terms and conditions by the user. Ourivesaria Figueira admits that the User has read, understood and is fully aware of the conditions present here. Ourivesaria Figueira has the right, at any time and without prior notice, to make changes to these terms, applicable to purchase, sale and order contracts. Therefore, we recommend reading it before placing a new order.
2. Registration
Making a purchase on our website implies registration and mandatory filling in of the User's data. Subsequently, the User will have access to their account and freedom to change their data. Registration implies full acceptance of the Terms and Conditions and Privacy Policy by the User.
3. User Obligations
Only customers aged 18 or over will be able to place orders on our website. Users under the age of majority must have authorization from their representatives. The User undertakes to:
• not use false identities;
• provide data personal details and correct addresses;
• correctly fill out the registration and order forms, providing truthful information;
The Customer is responsible for the veracity of the data communicated. If any information is incorrect or insufficient, Ourivesaria Figueira is not responsible for any delays or impossibilities in processing the order, or even non-delivery. Ourivesaria Figueira reserves the right to block access to the store and upon order request, to any user who does not comply with the aforementioned obligations, and/or who behaves inappropriately when using the website or towards its administrators.< /p>
4. Product Information and Content
The Ourivesaria Figueira Online store is intended for personal use only, copying, reproduction, transfer, distribution or storage of its contents, in part or in full, without prior written authorization, is prohibited for all purposes other than personal purposes. Despite our efforts to ensure that the information presented does not contain errors, errors can sometimes occur. We work to ensure that these are corrected as soon as they are detected. If, in the event that incorrect prices are displayed, when processing the order, we will detect the error. If the price of the item is lower than that shown, we will refund the excess. If the price is higher, we will contact the customer with a new proposal with the corrected price. The prices shown already include VAT at the legal rate in force. If you purchase an item that has different characteristics to those presented online, you have the right to exchange/return it in accordance with our terms. The measurements shown, such as sizes and weights, are approximate and may contain measurement errors. The photographs shown are for illustrative purposes only and may also show slight changes in color. Ourivesaria Figueira reserves the right to change, at any time, the commercial information presented about products, services, promotions and commercial conditions. The stock of products available in the online store is the same as in the physical store. There may be times, due to human errors or failures in synchronization between stores (physical and online), when stocks are not properly updated. If a product is not available after placing the order, you will be notified by email or telephone so that we can resolve the situation in the best way possible. You will have the possibility to cancel the order with the right to a refund, if you have already made the respective payment. The Customer may not demand other compensation, interest or compensatory damages, in addition to the aforementioned return, in cases of stock outages or errors in the information available on the website.
5. Online Orders
To make purchases on the website www.ourivesariafigueira.com it is necessary to register as a customer first. If you prefer not to do so, you can contact us by email geral@ourivesariafigueira.com, but we do not guarantee the same order processing times. On the website, simply enter the desired items in the shopping cart and follow the steps presented. The order is only processed after your payment has been confirmed, the items will not be reserved until this is done. Upon completing the purchase, Ourivesaria Figueira assumes that the User has read, understood and is fully aware of the conditions present here. When you complete your purchase, you will receive a confirmation email. If you find that any data is incorrect, please contact us so we can rectify it.
6. Shipping
Once payment has been confirmed, we will respond to your order as quickly as possible. All orders are processed within 2-3 business days and then shipped by courier. For personalized orders, processing time can be up to 5 days. At the moment you have two delivery methods available, delivery to the store and shipping by CTT.

We offer free shipping, in Portugal, on purchases over €100. For international shipping, shipping is free on purchases over €200. Orders shipped outside the European Union may be subject to delays as they pass through customs and are processed for customs or import taxes once they arrive in the destination country. Orders placed outside the European Union may be subject to taxes and/or customs, tax or import fees when they arrive in the destination country. It is the customer's responsibility for any charges of this nature that may be applied. These taxes vary from country to country, so we recommend that you contact your country's customs service for more information.
7. Order cancellation
The Customer may request the cancellation of their order via email geral@ourivesariafigueira.com citing the order number. If the order has not yet been processed, it will be cancelled. Cancellations of personalized items are not accepted if said modifications have already been made. Ourivesaria Figueira reserves the right not to process orders if it finds any inconsistency in the personal data provided or observes misconduct on the part of the customer. The order is only processed after your payment has been confirmed, the items will not be reserved until this is done.
8. Return
The Customer has up to 30 days after receiving their order to return any item they are not satisfied with. To start the return process, you must send an email to geral@ourivesariafigueira.com, indicating your name, the order/invoice number, the item reference (if there were several) and the reason for the return. Exchanges of personalized items are not accepted. Items must be returned intact and in perfect condition, in their original packaging, accompanied by appropriate documentation. Shipping must be made by registered mail, within the indicated deadline, to Figueira & Oliveira, Lda., Rua Príncipe D. Luís nº 4, 9360-218 Ponta do Sol. Return shipping costs will be the responsibility of the Customer. If the items to be returned are not in excellent condition, or if neglect of use is detected on the part of the customer, there will be no refund and the items will be sent to the initial shipping address. Upon receipt of the return, we will begin the refund process. The value does not include original shipping costs. The refund method will be agreed with the customer when this process begins and may take up to 30 days after receiving the return.
9. Warranty
All items are covered by a manufacturer's warranty for a period of 2 or 3 years, depending on the manufacturer. If any item ordered is defective or damaged, send us an email to geral@ourivesariafigueira.com, indicating the order/invoice number and the description of the defect/damage. The costs of returning items under these conditions are borne by Ourivesaria Figueira. Upon receipt of the article, a technical evaluation/verification will be carried out. If this is proven, we will repair, replace, exchange or refund the item, at no additional cost. Articles that show signs of misuse and/or any problem caused by negligent handling (e.g.: falling, damp, etc.), defects caused by abnormal wear or missing components are considered outside the warranty conditions.< /p>
10. Quality Policy
All items sold at Ourivesaria Figueira comply with Portuguese legislation. Items containing precious metal are duly marked, in compliance with the Legal Regime for Goldsmiths and Assay Offices (RJOC). The customer may use Assay Office services to verify the authenticity of the brands presented.
11. Privacy and Protection of Personal Data
At Ourivesaria Figueira we guarantee the confidentiality of all data provided by our customers, the collection and processing of personal data is in accordance with Regulation (EU) 2016/679 of the European Parliament and of the European Council, of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and their free movement (GDPR-Regulation General Data Protection). We only ask for personal data that is essential for the operation of the store and the delivery of orders. The omission or lack of accuracy of the data is the responsibility of the customer and may result in the cancellation of the order by Ourivesaria Figueira. The customer may, at any time, and without additional charges, rectify and update their personal data. Ourivesaria Figueira is not responsible for any possible leakage of information resulting from the lack of security on the internet network. Ourivesaria Figueira will not sell or share its database with third parties. Ourivesaria Figueira does not store data relating to payments made, such as debit or credit card details.

15. Applicable Law
All purchases made on www.ourivesariafigueira.com are subject to Portuguese legislation. Any conflict or divergence in interpretation of the General Terms and Conditions of Use will be submitted to the competent Portuguese court, including transactions made outside Portugal.
